Terms of service

Specific Terms of the NATIONAL Online Sales Contract

These Specific Terms of the Purchase Contract apply to online sales made through the website www.mew-jewellery.com (hereinafter, the WEBSITE), owned by MEW JEWELLERY (B75268961)

The customer's use of the services offered on the WEBSITE presupposes, in all cases, acceptance of these Specific Terms of the Online Purchase Contract, in the version published by MEW at the time the purchase order is placed. Therefore, customers should read these Specific Terms before making a purchase, as well as the portal's general terms and conditions of use.

Please also read our Privacy Statement before placing your order. By using this WEBSITE or placing an order through it, the customer agrees to be bound by these Terms and our Privacy Statement; therefore, if you do not agree to all the Terms and the Privacy Statement, you must not place an order.



1. Purpose of the Contract

These specific terms for online purchases apply to the purchase of any product available on the WEBSITE made by customers whose delivery address is in Spain, Andorra, Gibraltar or Portugal.

The prices of each item of jewellery are indicated on the website on the date the order is placed. The prices are detailed for each item and include taxes and fees. The amount of shipping costs and any other service is also specified and will be itemised for the customer when the order is placed.

The purchase service through the WEBSITE governed by these Specific Terms only permits the purchase of products and services by customers over 18 years of age whose delivery address is in Spain, Andorra, Gibraltar or Portugal.

MEW reserves the right to cancel a customer's access account if fraudulent, speculative or bad-faith acts are detected in the use of this service.

MEW may modify and update items and prices, where it deems appropriate, in accordance with the company's commercial criteria, although such changes will not affect products that have been accepted.

All product orders are subject to product availability and, accordingly, if difficulties arise regarding their supply, the order will be cancelled and any amount the customer may have paid will be refunded.



2. Contracting Procedure

The information and details contained on the WEBSITE do not constitute an offer for sale, but an invitation to do business. No contract shall exist between the customer and MEW in relation to any product until the order has been expressly accepted by MEW (even if the customer's account has already been charged). If the offer is not accepted and the customer's account has already been charged, the amount charged shall be refunded to the customer in full.

To place an order, the customer must follow the online purchasing procedure and click "Place the order". The customer will then receive an email acknowledging receipt of the order (Order Confirmation).

Only those products listed in the Order Confirmation shall be subject to the Contract. MEW shall not be obliged to supply any other products that may have been ordered by the customer until their dispatch has been confirmed in a separate Shipping Confirmation.

Exceptional circumstances may even exist (in accordance with Law 10/2010 of 28 April on the prevention of money laundering and terrorist financing) that require the processing of an order to be refused after the Order Confirmation has been sent. MEW reserves the right to do so at any time, at its sole discretion.



3. Obligations of the parties

3.1. Payment

The price of the products shall be that stipulated on the WEBSITE at any given time, except in the event of an obvious error. Although MEW endeavors to ensure that all prices shown on the WEBSITE are correct, errors may occur. If MEW discovers an error in the price of products ordered by the customer, MEW shall, after informing the customer as soon as possible, cancel the order. If MEW is unable to contact the customer, the order shall be deemed cancelled and any amounts paid shall be refunded in full.

MEW is not obliged to supply products (even if a Shipping Confirmation has been sent) if the pricing error is obvious and unequivocal and could reasonably have been recognized by the customer as an incorrect price.

MEW product prices may vary, but (except as provided above) any changes will not affect orders for which a Shipping Confirmation has already been sent.

Given the specific nature of online purchases, the price of the products indicated on the WEBSITE refers exclusively to purchases made through the WEBSITE and does not necessarily correspond to the retail price at MEW establishments. Accordingly, the price indicated on the WEBSITE is binding only for online purchases.

The prices on the Website include VAT but exclude shipping costs, which shall be added to the total amount due and indicated to the customer in a breakdown.

Once the customer has made their purchases, all the items they wish to purchase will have been added to their bag, and the next step will be to process the order and make the payment. To do so, the customer shall follow 5 steps:

  1. The customer shall click "View Cart" at the top of the page to add the products they wish to purchase.
  2. The customer shall complete and verify their contact information, order details, and the address to which they wish the order to be sent.
  3. The customer shall choose the payment method with which they wish to make the purchase: credit card, debit card, PayPal, or gift voucher, and shall enter the corresponding information.
  4. The customer shall accept the “Terms and Conditions”.
  5. The customer shall confirm the purchase by clicking “Place order".

The customer may pay using Visa, Maestro, Mastercard, and PayPal cards. To minimize the risk of unauthorized access, the customer will be redirected to the virtual payment gateway/PayPal screen, which will authorize payment for the order.

By clicking "Authorize Payment", the customer confirms that the credit card belongs to them.

Credit cards shall be subject to checks and authorization by the issuing institution; if that institution does not authorize the payment, MEW shall not be liable for any delay or failure to deliver and, ultimately, for failing to formalize the sales contract with the customer.

Discounts

Discounts offered by MEW JEWELLERY shall apply exclusively to the basic price of the items and shall not extend to additional personalizations or shipping costs.

Value Added Tax (VAT)

In accordance with the regulations in force, every purchase made through the Website shall be subject to Value Added Tax (VAT), which shall be charged at the rate in force at the time of delivery.

Orders destined for Ceuta and Melilla will be exempt from VAT, without prejudice to the application of the relevant taxes and duties in accordance with the regulations in force in each location.

3.2. Delivery

Shipping will be carried out by CORREOS and NACEX, companies independent of MEW that undertake to deliver the product paid for by the customer to the delivery address within an approximate period of:

These time frames may be extended by 10 - 28 business days for any of the following reasons:

  • Personalization of the products.
  • Special items.
  • Unforeseen circumstances not attributable to MEW JEWELLERY.

It must be noted in any event that deliveries are not made on Saturdays or Sundays.

For the purposes of these Terms, delivery shall be deemed to have taken place, or the product(s) shall be deemed to have been delivered, when receipt thereof is signed at the agreed delivery address.

The risks relating to the Products shall be borne by the customer from the time of their delivery.

The customer shall acquire ownership of the products when full payment of all amounts due in relation to them, including delivery costs, has been received.


4. Withdrawal


RETURNS AND CANCELLATIONS

All MEW pieces are individually made to order, according to the specifications selected by each customer.

We do not work with finished jewellery held in stock. Once the order has been placed, each piece is created and/or finished specifically for you. Depending on the design, the selected options may include initials, names, letters, symbols, engravings, stones, size, length, measurements, composition and finish.

Depending on the commissioned design, our pieces may undergo various individual production processes, including casting, hand engraving, setting, assembly, polishing and plating.

RETURNS AND EXCHANGES

As MEW pieces are made according to the specifications selected by the customer and/or are clearly personalized, we do not accept cancellations, returns or exchanges due to a change of mind.

In countries or territories where products personalized or made according to the consumer's specifications are excluded from the statutory right of cancellation or withdrawal, this policy shall apply in accordance with that exception.

Nothing set out in this policy limits or excludes any mandatory rights to which you may be entitled as a consumer under the applicable legislation in your country of residence.

DEFECTIVE OR INCORRECT ITEMS

This policy does not affect any rights to which you may be legally entitled if the piece received is defective or does not correspond to the specifications confirmed in your order.

If you believe that you have received a defective or incorrect piece, please contact us at hello@mew-jewellery.com, stating your order number and attaching photographs of the piece so that our team can review the case.

CAREFULLY REVIEW YOUR PERSONALIZATION

Before completing your purchase, carefully review all personalization details, including selected names, initials, text, stones, sizes, lengths, and finishes.

Once the order has been placed, we may specifically begin producing your piece in accordance with the selected specifications; therefore, changes or cancellations will not be possible once the production process has begun.

When placing an order with MEW Jewellery, you acknowledge that your piece will be made specifically in accordance with the specifications selected in your order and that pieces customised or made in accordance with those specifications cannot be cancelled, returned or exchanged due to a change of mind, without prejudice to any mandatory rights you may have as a consumer under applicable law.



5. Existence of warranty

MEW offers its customers products and services of the highest quality.

The gold used to manufacture the pieces is 750 fineness (18 carats), and the silver is 925 fineness.

MEW JEWELLERY diamonds of 0.30 carats or more are accompanied by their GIA certificate and comply with the conditions of the “Kimberley Process” (a certification system for the international trade in diamonds not originating from conflict countries).

Given the special characteristics of the products marketed by MEW on its website, slight differences exist between each product or service purchased, mainly due to the unique and exclusive nature of each and every one of the materials and stones used in their manufacture, which is also largely carried out by hand. Accordingly, no two MEW products or services are exactly alike and, in any event, it is unavoidable that the product delivered to the customer will differ slightly from that shown in the photographs included in the website purchase process (even if it were the same product). Under no circumstances will these differences entail the delivery of products or services made with materials of lower quality than those expressly mentioned on the Portal. Likewise, the customer is informed and acknowledges that the size of the photographs contained on the Portal does not correspond to the actual size of the MEW products offered.

Accordingly, the customer is informed of and expressly consents to these circumstances and differences, which may not constitute grounds for termination of the Contract.

In any event, without prejudice to the provisions set out at the beginning of this section, MEW JEWELLERY products purchased by the customer through the purchase procedure established on the WEBSITE are covered by the statutory guarantee applicable to consumer goods, namely, their conformity with their description on the WEBSITE and with these Specific Terms and Conditions.

7. Competent jurisdiction and applicable law

The Spanish courts shall have jurisdiction over any dispute arising from this online sales contract. Spanish law (the Consolidated Text of the General Law for the Protection of Consumers and Users) shall likewise apply to all matters not provided for in this contract.

The European Commission provides a platform for alternative dispute resolution, which can be accessed at: http://ec.europa.eu/consumers/odr/ MEW is not affiliated with any association or organization offering an out-of-court dispute resolution system.


8. Intellectual and industrial property

All content (including the graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs, and any elements appearing on the WEBSITE), unless expressly stated otherwise, is exclusively owned by MEW or third parties.

No intellectual or industrial property rights relating to the WEBSITE or any of its constituent elements are transferred to the customer, and the customer is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or using any of them in any manner, by any means or procedure, except where legally permitted or authorized by the owner of the corresponding rights.

The customer may view and obtain a temporary private copy of the content for their exclusive personal, private and non-collective use on their computer systems (software and hardware), provided that this is not for the purpose of carrying out collective or commercial or professional activities. The customer must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available or indicated for that purpose in each case, or those customarily used on the Internet (provided that the latter do not entail a risk of damaging or rendering the WEBSITE unusable). The customer must respect at all times all intellectual and industrial property rights relating to the WEBSITE, owned by MEW or third parties.

In any event, MEW reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Specific Terms and Conditions.
