Specific conditions of the NATIONAL online sales contract
These Specific Conditions of the Purchase Contract apply to online sales made through the website www.mew-jewellery.com (hereinafter, WEBSITE) owned by MEW JEWELLERY (B75268961)
The customer's use of the services offered on the WEBSITE implies, in any case, acceptance of these Specific Conditions of the Online Purchase Contract, in the version published by MEW at the time of the purchase order. Therefore, it is advisable that the customer reads these Specific Conditions before making a purchase, as well as the general terms and conditions of use of the portal.
Please also read our Privacy Statement before placing your order. By using this WEBSITE or placing an order through it, the customer agrees to be bound by these Conditions and our Privacy Statement, so if you do not agree with all the Conditions and the Privacy Statement, you should not place any order.
1. Object of the contract
These specific online purchase conditions apply to the purchase of any product on the WEBSITE made by customers with a delivery address in Spain, Andorra, Gibraltar, or Portugal.
The prices of each piece of jewelry are indicated on the website on the date the order is placed. Prices are detailed for each item, including taxes and fees. The amount of shipping costs and any other service fees is also specified and will be shown to the customer separately at the time of order.
The purchase service through the WEBSITE regulated by these Specific Conditions only allows the purchase of products and services by customers over 18 years old with a delivery address in Spain, Andorra, Gibraltar, or Portugal.
MEW reserves the right to cancel a customer's access account if fraudulent, speculative, or bad faith actions are detected in the use of this service.
MEW will modify and update articles and prices if deemed appropriate, based on the company's commercial criteria, although changes will not affect products that have already been accepted.
All product orders are subject to availability, and in this regard, if supply difficulties occur, the order will be canceled and any amount paid by the customer will be refunded.
2. Hiring Procedure
This information and the details contained on the WEBSITE do not constitute a sales offer but an invitation to do business. No contract will exist between the customer and MEW regarding any product until the order has been expressly accepted by MEW (even if the charge has already been made to the customer's account). If the offer is not accepted and any charge has already been made, the amount will be fully refunded to the customer.
To place an order, the customer must follow the online purchase procedure and click on "Place Order." After this, they will receive an email acknowledging receipt of their order (Order Confirmation).
Only the products listed in the Order Confirmation will be subject to the Contract. MEW will not be obligated to supply any other product that may have been ordered by the customer until its shipment is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and terrorist financing) that require rejecting the processing of an order after the Order Confirmation has been sent. MEW reserves the right to do so at any time, at its sole discretion.
3. Obligations of the parties
3.1. Payment
The product price will be the one stipulated at any given time on the WEBSITE, except in the case of a manifest error. Although MEW tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If MEW discovers a pricing error for products ordered by the customer, MEW will inform the customer as soon as possible and proceed to cancel the order. If MEW cannot contact the customer, the order will be considered canceled and any amounts paid will be fully refunded.
MEW is not obligated to supply products (even if the Shipping Confirmation has been sent) if the price error is obvious and unmistakable and could reasonably have been recognized by the customer as an incorrect price.
MEW product prices may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the particularities of online shopping, the price of the products indicated on the WEBSITE refers solely and exclusively to purchases made on it, and does not have to match the retail price in MEW stores. Accordingly, the price shown on the WEBSITE is only considered binding for online purchases.
Website prices include VAT but exclude shipping costs, which will be added to the total amount due and shown to the customer in a detailed breakdown.
Once the customer has made their purchases, all the items they want to buy will have been added to their bag, and the next step will be to process the order and make the payment. To do this, the customer will follow 5 steps:
- They will click on "View Cart" at the top of the page to add the products they wish to buy.
- They will fill in and verify the contact information, order details, and the address where they want the order to be sent.
- They will choose the payment method they wish to use: credit card, debit card, Paypal, or gift voucher and enter the corresponding information.
- They will accept the “Terms and Conditions”.
- They will confirm the purchase by clicking “Place Order".
The customer can pay with Visa, Maestro, Mastercard, and Paypal cards. To minimize the risk of unauthorized access, they will be redirected to the virtual payment gateway/Paypal screen that will authorize the order payment.
By clicking "Authorize Payment" the customer confirms that the credit card is theirs.
Credit cards will be subject to checks and authorizations by the issuing entity; if such entity does not authorize the payment, MEW is not responsible for any delay or failure to deliver and, ultimately, for not proceeding to formalize the sales contract with the customer.
Discounts
Discounts offered by MEW JEWELLERY will apply exclusively to the base price of the items and will not extend to additional customizations or shipping costs.
Value Added Tax (VAT)
In accordance with current regulations, all purchases made through the Website will be subject to Value Added Tax (VAT), which will be applied at the rate in effect at the time of delivery.
For orders destined to Ceuta and Melilla, deliveries will be exempt from VAT without prejudice to the application of the corresponding taxes and duties according to the regulations in force in each of them.
3.2. Delivery
Shipping will be carried out by the company CORREOS and NACEX, independent from MEW, which commit to delivering the product paid for by the customer to the delivery address within an approximate timeframe of:

These timeframes may be extended by 10 - 28 business days for some of the following reasons:
- Product customization.
- Special items.
- Unforeseen circumstances not attributable to MEW JEWELLERY.
It should be noted in any case that deliveries are not made on Saturdays or Sundays.
For the purposes of these Conditions, delivery or that the product(s) have been delivered will be understood to have occurred at the moment of signing the receipt at the agreed delivery address.
The risks of the Products will be borne by the customer from the moment of delivery.
The customer will acquire ownership of the products when full payment of all amounts due in relation to them, including shipping costs, has been received.
4. Withdrawal
The customer does not have the right to withdraw from the contract once the item has been ordered, as these are personalized, made-to-measure jewelry.
5. Existence of warranty
MEW offers its customers products and services of the highest quality.
The gold used for the manufacture of the pieces is 750 thousandths (18 carat) fine gold, and the silver is 925 thousandths fine silver.
MEW JEWELLERY diamonds of 0.30 carats or more come with their GIA certificate and comply with the conditions of the “Kimberley Process” (certification system for the international trade of diamonds not originating from conflict countries).
Given the special characteristics of the products marketed by MEW on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every material and stone used in their making, which is also largely handcrafted. Therefore, no two MEW products or services are exactly the same, and in any case, it is inevitable that the product delivered to the customer differs slightly from the one shown in the photographs included in the website purchase process (even if it were the same). Under no circumstances will these differences imply the delivery of products or services with lower quality materials than those expressly mentioned on the Portal. Likewise, the customer is informed and aware that the size of the photographs contained on the Portal does not correspond to the actual size of the MEW products offered.
Therefore, the customer is informed and expressly consents to these circumstances and differences, which cannot be grounds for contract termination.
In any case, without prejudice to what is established at the beginning of this section, MEW JEWELLERY products purchased by the customer through the purchase procedure established on the WEBSITE come with the legal warranty applicable to consumer goods, that is, their conformity with their description on the WEBSITE and with these Specific Conditions.

7. Competent jurisdiction and applicable law
For any dispute arising from this online sales contract, the Spanish courts shall have jurisdiction. Spanish law (Consolidated Text of the General Law for the Defense of Consumers and Users) shall also apply to all matters not provided for in this contract.
The European Commission offers a platform for alternative dispute resolution, accessible at: http://ec.europa.eu/consumers/odr/ MEW is not affiliated with any association or organization offering an out-of-court dispute resolution system.
8. Intellectual and industrial property
All content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs, and any elements appearing on the WEBSITE), unless expressly stated otherwise, are the exclusive property of MEW or third parties.
No intellectual or industrial property rights over the WEBSITE or any of its components are transferred to the customer, and the customer is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding, or using any of them in any way or by any means or procedure, except where legally permitted or authorized by the holder of the corresponding rights.
The customer may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided it is not for the purpose of carrying out collective, commercial, or professional activities. The customer must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available or indicated for this purpose or those commonly used on the Internet (provided that the latter do not pose a risk of damage or disabling the WEBSITE). The customer must always respect all intellectual and industrial property rights over the WEBSITE, owned by MEW or third parties.
In any case, MEW reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Specific Conditions.
